SHIPPING, DELIVERY & COLLECTION POLICY
1. Standard Delivery Area
Our standard delivery service applies to mainland UK.
Deliveries to areas outside our standard mainland UK delivery area, including certain remote areas, islands and other locations requiring specialist carriage, may be subject to additional delivery charges.
Where an additional charge applies, we will advise you before dispatch or, where appropriate, before accepting the order for delivery to that location.
Customers are welcome to contact us before ordering if they would like confirmation of delivery availability or charges for their postcode.
2. Standard Delivery Times
Our standard delivery timeframe is normally 3–5 working days, subject to product availability, destination, carrier availability and the nature and size of the machinery being delivered.
Delivery times shown or quoted are estimates unless MDL Powerup Ltd expressly agrees a specific delivery date or period with you.
Certain large, specialist, out-of-stock, specially ordered or unusually transported items may take longer. Where this applies, we will provide appropriate delivery information.
If you require an item more urgently, please contact us before ordering or as soon as possible afterwards. Faster delivery may be possible by arrangement, depending on stock and carrier availability, but is not guaranteed unless expressly agreed by MDL Powerup Ltd.
Nothing in this policy affects any delivery rights which a consumer has under applicable law.
3. Delivery Charges
Applicable delivery charges will be displayed, calculated, quoted or otherwise communicated to the customer as appropriate before the customer becomes bound to pay them.
Standard delivery charges apply only to destinations and services covered by our standard delivery service.
Additional charges may apply to deliveries outside mainland UK, remote locations, islands, locations subject to carrier surcharges, unusually large or heavy machinery, or deliveries requiring specialist transport.
Where delivery charges cannot reasonably be calculated automatically, please contact us for a quotation.
4. Machinery and Pallet Deliveries
Many of our products are agricultural, groundcare or other machinery which is larger and heavier than an ordinary parcel.
Machinery may therefore be delivered by pallet network, specialist carrier or another suitable delivery service.
Most standard palletised machinery deliveries are arranged using a tail-lift delivery service, where appropriate.
Customers should ensure that there is adequate access for a suitable commercial delivery vehicle and that the delivery location is safe and reasonably accessible.
Delivery drivers are not responsible for assembling, installing, commissioning or moving machinery to its final operating or storage position unless MDL Powerup has expressly agreed such a service in advance.
5. Large and Triple-Pallet Machinery
Certain particularly large or heavy machines, including some items occupying multiple or triple pallet spaces, cannot reasonably or safely be unloaded using a standard tail lift.
For these deliveries, the customer may be required to provide suitable mechanical unloading equipment, such as a forklift, telehandler or other appropriately rated handling equipment.
Where customer-provided unloading equipment is required, MDL Powerup will advise the customer where reasonably practicable before delivery.
It is the customer's responsibility to ensure that any unloading equipment supplied by them is suitable for the weight and dimensions of the machinery and is operated safely by a suitably competent person.
Customers who are unsure whether they have suitable unloading facilities should contact us before delivery is arranged.
6. Delivery Access
The customer is responsible for providing accurate delivery information and making us aware of relevant access restrictions.
This may include narrow roads, restricted entrances, low bridges, weight restrictions, unsuitable surfaces, restricted turning areas or other circumstances that could prevent a commercial delivery vehicle from safely reaching the delivery point.
Where practicable, please tell us about such restrictions when placing your order or before dispatch.
We or our carrier may decline to enter a location where it would be unsafe or unreasonable to do so.
7. Customer Unavailable or Unable to Accept Delivery
The customer should ensure that an appropriate person is available to receive the goods where attendance is required.
Where we have advised that unloading equipment is required, the customer should ensure that suitable equipment and a competent operator are available when the delivery arrives.
If a delivery cannot reasonably be completed because:
- nobody is available to receive the goods;
- incorrect or incomplete delivery information has been supplied;
- suitable access has not been provided;
- required unloading equipment is unavailable; or
- another circumstance within the customer's reasonable control prevents delivery,
we reserve the right, to the extent permitted by law, to charge the reasonable additional costs actually incurred as a result, which may include redelivery, additional carriage, waiting time, recovery or storage charges.
For consumers, no additional charge will be imposed where doing so would be contrary to applicable consumer law.
8. Delivery Inspection and Transit Damage
Customers should inspect delivered goods as soon as reasonably practicable.
If packaging or machinery appears to have been damaged during transport, please photograph the packaging and goods and contact MDL Powerup as soon as reasonably possible.
Where possible, visible damage should also be noted with the delivery driver or on the carrier's delivery documentation.
Prompt notification helps us investigate a claim with the carrier. However, failure by a consumer to report damage immediately does not remove any statutory rights or remedies which the consumer may have.
Please retain relevant packaging where reasonably practicable until we have advised whether it is required for inspection.
9. Missing or Incorrect Goods
If an item appears to be missing from your delivery, or you believe that the wrong product has been supplied, please contact MDL Powerup as soon as reasonably practicable.
Please provide your order details and, where useful, photographs of the goods and packaging so that we can investigate.
Nothing in this section restricts any statutory rights or remedies which apply.
10. Risk During Delivery
For consumers, responsibility for loss of or damage to goods during delivery will pass in accordance with applicable consumer law.
For business, agricultural, contracting, trade and professional customers, risk will pass in accordance with our applicable Terms & Conditions of Sale and any specific delivery arrangements agreed for the order.
Nothing in this policy excludes or restricts liability which cannot lawfully be excluded or restricted.
11. Customer Collection
Customers may collect orders from MDL Powerup Ltd by prior appointment.

Please do not travel to collect machinery until MDL Powerup has confirmed that the order is ready and a collection arrangement has been agreed.
Customers collecting machinery are responsible for providing a suitable vehicle or trailer and for ensuring that the machinery can be transported safely and legally.
Where the customer is responsible for securing the load, the customer must ensure that suitable restraints and securing arrangements are used.
12. Delays Outside Our Reasonable Control
Delivery may occasionally be affected by circumstances outside our reasonable control, including severe weather, road closures, carrier disruption, accidents, industrial action or other transport disruption.
Where we become aware of a material delay, we will take reasonable steps to communicate with the customer and arrange delivery as appropriate.
Nothing in this section removes any right a consumer has where goods are not delivered within an agreed period or within another period required by law.
13. Consumers
Nothing in this Shipping, Delivery & Collection Policy excludes, restricts or replaces statutory rights or remedies available to consumers.
Where consumer law requires MDL Powerup to deliver within an agreed time or provides the consumer with remedies for late or failed delivery, those rights continue to apply.
14. Business Customers
Where goods are purchased wholly or mainly for business, agricultural, contracting, professional or trade purposes, the purchaser is treated as a business customer for the purposes of this policy.
Delivery dates or times provided to business customers are estimates unless MDL Powerup expressly agrees otherwise in writing.
Our Terms & Conditions of Sale also apply to business orders, including any applicable provisions concerning delivery, risk, liability, delay and consequential or business losses.
Nothing in this section excludes or restricts liability which cannot lawfully be excluded or restricted.
