MDL POWERUP – 3 YEAR WARRANTY TERMS & CONDITIONS
1. Our Warranty
MDL Powerup Ltd is committed to supplying reliable machinery and equipment. Subject to the terms, conditions and exclusions set out below, qualifying new machinery supplied by MDL Powerup Ltd is covered by our 3 Year Warranty from the original date of purchase.
The warranty is structured as follows:
First 12 months – Parts & Labour Warranty
During the first 12 months, MDL Powerup will, at its discretion, repair or replace parts which we determine have failed as a result of a manufacturing or material defect.
Where a valid warranty claim requires repair work to be carried out by MDL Powerup or an authorised repairer, reasonable labour costs will be covered during this period.
Where MDL Powerup determines that transport of the machine is reasonably necessary to complete an accepted warranty repair, MDL Powerup may arrange or contribute towards reasonable transport costs. Transport arrangements must be agreed with MDL Powerup before the machine is returned or transported. Unauthorised transport, recovery or third-party costs will not be reimbursed.
Months 13–36 – Parts Only Warranty
For the remaining 24 months, the warranty is parts only.
Where MDL Powerup confirms that a component has failed because of a manufacturing or material defect, MDL Powerup will supply the appropriate replacement part, subject to the exclusions in these terms.
During months 13–36, labour, diagnosis, removal, installation, servicing, travel, recovery, transport, carriage and other associated costs are not included in the warranty and are the customer's responsibility.
Where reasonably practicable, replacement parts may be supplied directly to the customer for installation by a suitably competent person.
2. What the Warranty Covers
The warranty covers defects in materials and workmanship occurring during normal and appropriate use of the machine within its stated operating specifications.
Whether a failure is covered under warranty will be determined following reasonable inspection and diagnosis by MDL Powerup or, where appropriate, an authorised representative.
MDL Powerup may choose to repair a defective component, supply a replacement component, or provide another appropriate remedy in accordance with these warranty terms and applicable law.
Replacement parts supplied under warranty do not restart or extend the original warranty period. They are covered for the remainder of the original machine's warranty period, subject always to the customer's statutory rights.
3. What Is Not Covered
The warranty does not cover faults, failure, deterioration or damage resulting from:
- normal wear and tear;
- misuse, abuse, neglect or operation contrary to the operator's manual or safety instructions;
- use of the machine outside its intended purpose or specified operating limits;
- overloading or exceeding stated tractor, PTO, hydraulic, power, towing, load or other operating limits;
- accident, collision, impact or external damage;
- damage caused by foreign objects including stones, wire, metal, timber, debris or other unsuitable materials;
- contact with overhead or underground services or power lines;
- incorrect assembly, installation, adjustment or operation;
- inadequate or incorrect maintenance or servicing;
- failure to carry out maintenance at the intervals specified in the operator's manual;
- continued operation after a fault, abnormal noise, vibration, leak, overheating or other defect becomes apparent;
- incorrect, contaminated, insufficient or unsuitable fuel, oils, lubricants, hydraulic fluids or coolants;
- water, dirt or other contamination entering fuel, lubrication or hydraulic systems;
- corrosion, cosmetic deterioration or damage caused by inappropriate storage or exposure to environmental conditions;
- unauthorised alterations or modifications;
- fitment or use of unsuitable or non-approved parts or accessories where these have caused or contributed to the failure;
- repairs or modifications carried out incorrectly by persons other than MDL Powerup or an appropriately competent repairer;
- damage occurring during transport or handling not arranged by MDL Powerup; or
- any other damage or failure not attributable to a defect in materials or workmanship.
4. Wear, Service and Consumable Items
Items which are subject to wear or routine replacement through normal use are not covered simply because they require replacement during the warranty period.
These include, but are not limited to:
blades, flails, hammers, cutting edges, belts, chains, bearings where failure results from normal wear or inadequate maintenance, clutch components and linings, filters and filter elements, spark plugs, oils, lubricants, hydraulic fluids, hoses subject to normal wear, flap kits, skids, wear pads, soil-engaging parts, shields, guards, tyres, inner tubes, tracks and other consumable or wear components.
However, this exclusion does not apply where MDL Powerup determines that the item itself was defective in materials or manufacture rather than having failed through normal wear or another excluded cause.
5. Engines and Third-Party Components
Certain engines, batteries, electrical components or other proprietary components may be supplied with a separate manufacturer's warranty.
Where a component is covered by a manufacturer's own warranty, MDL Powerup may require the warranty claim to be dealt with in accordance with that manufacturer's warranty procedure.
Any separate manufacturer's warranty is subject to its own terms, conditions and exclusions.
This does not affect any legal rights the customer may have against MDL Powerup as the seller.
6. Maintenance and Servicing
The customer is responsible for ensuring that the machine is operated, inspected, maintained and serviced in accordance with the operator's manual and any maintenance instructions supplied with the machine.
MDL Powerup may request reasonable evidence of servicing or maintenance when investigating a warranty claim where maintenance may be relevant to the reported failure.
Failure to maintain the machine does not automatically invalidate the entire warranty. However, a claim may be declined where inadequate or incorrect maintenance has caused or materially contributed to the failure being claimed for.
7. Making a Warranty Claim
If you believe your machine has developed a fault covered by this warranty, please contact MDL Powerup before arranging repairs, dismantling the machine or returning it.
We may ask you to provide:
- your name and contact details;
- proof of purchase;
- machine model and serial number;
- date of purchase;
- a description of the fault;
- photographs and/or video showing the problem;
- information concerning how the machine was being used when the fault occurred; and
- relevant servicing or maintenance information where reasonably required.
Customers should stop using machinery where continued operation could cause additional damage or present a safety risk.
No third-party repair, labour, recovery, transport or other costs should be incurred on the assumption that MDL Powerup will reimburse them unless MDL Powerup has authorised those costs in advance.
8. Inspection and Diagnosis
MDL Powerup may require a machine, component or defective part to be made available for inspection before accepting a warranty claim.
Where appropriate, we may initially diagnose faults remotely using photographs, video, telephone support or other information supplied by the customer.
If inspection establishes that a fault is not covered by this warranty, any repair, replacement, collection, delivery or other work requested by the customer may be chargeable. We will advise the customer before carrying out chargeable repair work.
9. Transport and Return Costs
During the first 12 months, where MDL Powerup accepts a claim as a valid warranty claim and determines that transport of the machine is reasonably necessary, MDL Powerup will determine the appropriate method of transport or repair and whether reasonable transport costs will be covered.
Customers must obtain authorisation from MDL Powerup before arranging transport where reimbursement is expected.
During months 13–36, the warranty is parts only and all transport, collection, delivery, recovery, travel and carriage costs are the responsibility of the customer, except where applicable law requires otherwise.
10. Consequential and Business Losses
Subject to applicable law, this warranty does not cover indirect or consequential losses arising from machinery being unavailable or out of service, including loss of production, loss of contracts, loss of business, loss of profit or revenue, hire of replacement machinery or other business interruption costs.
Nothing in these warranty terms excludes or limits any liability which cannot lawfully be excluded or limited.
11. Original Purchaser and Transfer
This warranty is provided to the original purchaser of the machine and is not transferable to a subsequent owner unless MDL Powerup agrees otherwise in writing.
This restriction relates to the additional MDL Powerup 3 Year Warranty and does not affect any rights which a subsequent owner may have independently under applicable law.
12. Warranty Period
The warranty commences on the date the machine is supplied to the original purchaser and expires 36 months later.
The warranty consists of:
Months 0–12: qualifying parts and labour, together with transport costs where expressly accepted as appropriate by MDL Powerup.
Months 13–36: qualifying replacement parts only.
Any product specifically advertised or sold with different warranty terms will be subject to the warranty stated for that product at the time of sale.
13. Consumer Statutory Rights
This warranty is in addition to, and does not affect, your statutory rights.
If you are purchasing as a consumer, goods supplied by MDL Powerup must meet the requirements imposed by applicable consumer law, including requirements relating to satisfactory quality, fitness for purpose and conformity with their description.
Nothing in these warranty terms is intended to exclude, restrict or replace any rights or remedies that cannot lawfully be excluded or restricted.
The Consumer Rights Act specifically requires a free guarantee offered to consumers to state that statutory rights are unaffected. It also requires the guarantee to explain its duration and territorial scope and identify the guarantor.
14. Business Customers
Where machinery is purchased wholly or mainly for business, trade, agricultural, contracting or professional purposes, consumer legislation may not apply.
For business customers, this warranty sets out the additional warranty provided by MDL Powerup in relation to the machinery, subject to any rights and liabilities which cannot lawfully be excluded or restricted.
Any limitation or exclusion of liability applicable to a business customer remains subject to applicable law, including any relevant requirement of reasonableness.
15. Territorial Coverage
Unless otherwise agreed in writing, this warranty applies to machinery originally purchased directly from MDL Powerup Ltd for use in the United Kingdom.
Customers outside the UK should contact MDL Powerup before purchase to confirm the warranty arrangements applicable to their location.
